Is it difficult for a claimant to pursue a Medical Negligence claim?

A medical negligence claim can be very complex.  It is different from ordinary personal injury litigation.  A claimant often face difficulties in finding the right lawyer who is able to deal with the following obstacles:

  1. To start the claim, it is necessary to obtain the full medical records.  The lawyer needs to be familiar with medical notes and language. The medical records need to be carefully analyzed.

  2. To establish the claim, expert evidence must be obtained.  The lawyer needs to have the ability to find and liaise with the right expert to deal with all the issues to prove the case.

  3. By comparison, it would generally be easier for a doctor and hospital (who are within the medical community) to find experts who can support their case.

It is therefore important to choose the right lawyer who would be able to tackle the above problems.
